HOW TO HANDLE DISPUTES WITH YOUR PROPERTY MANAGER

 

The Residential Tenancies Authorities ( RTA) Receives over 18,000 requests for conciliation each year. To help parties resolve disputes and avoid having the matter escalate to the Small Claims Tribunal, the RTA operates a dispute resolution service.

 

The RTA has found one of the best means of achieving a positive outcome for all parties is through a Conciliation conference. A Conciliation conference is essentially a three way telephone conference that allows all parties to not only have their say, but to also hear the concerns of the other party in a non-invasive manner.

 

Each party involved in the dispute receives a letter from the RTA stating what day and time the conference is to take place, allowing all involved ample time to gather information and supporting documentation. The role of the RTA throughout the process is to assist parties achieve a mutually agreeable outcome whilst maintaining 100 percent impartiality.

 

The RTA does not represent one side of the other. Rather, as an impartial body, The RTA provides the mechanism and knowledge needed so that the parties can reach an agreement together. Throughout the conference, each party is afforded an opportunity to put forward their version of events without any interruptions.

 

Parties may be asked to talk to one another directly while the RTA conciliator listens and controls the meeting, while at other times, the parties may be directed to respond to the conciliator only.

 

Since the introduction of the Conciliation Conference in 2008, the RTA has achieved a significant success rate. Should the RTA not be able to assist the party’s reach an amicable outcome, a Notice of Unresolved Dispute will be issued enabling the matter to be heard before the Small Claims Tribunal.

 

To ensure a successful conciliation, parties should be well prepared and on time for the conference, be in a relatively quiet place, have a realistic idea about the outcome they are trying to achieve, and all about an hour for the process.
